NATIONAL LABOR RELATIONS COMMISSION (NLRC) ADVISORY ON REPUBLIC ACT (R.A.) NO. 12021, MAGNA CARTA OF FILIPINO SEAFARERS.
Republic Act (R.A.) No. 12021, otherwise known as the “Magna Carta of Filipino Seafarers”, was signed into law by President Ferdinand R. Marcos, Jr. on 23 September 2024 and took effect on 12 October 2024. The implementing Rules and Regulations of R.A. No. 12021 was signed by the Department of Migrant Workers (DMW) and the Maritime Industry Authority (MARINA) on 8 January 2025 and will take effect on 25 January 2025.
To implement Section 59 of R.A. No. 12021, the Department of Labor and Employment (DOLE) also issued Department Order No. 247 (Series of 2025) on 15 January 2025.
Thereafter, the Commission en banc issued Resolution No. 01-25 adopting guidelines in the disposition and execution of decisions granting monetary awards, salaries, wages, statutory benefits, and death and disability claims of Filipino seafarers.
Pending issuance by the Commission of the Rules of Procedure to implement R.A. No. 12021, all Presiding/Commissioners and Executive/Labor Arbiters shall be guided by the abovementioned issuances in the disposition of disputes, claims, and complaints involving overseas Filipino seafarers.
